Levy  died near Laurel Place  when he was hit by the 6:45 a.m. Montclair-Boonton train bound for Hoboken near the Mountain Avenue Station. "Based on interviews," Smith said, "it appears that the deceased entered the area of the track and did not attempt to remove himself when the train was approaching."  Smith said the information comes from eyewitnesses, including crew members, who were interviewed by NJ Transit Police. Joan Juengling was identified by NJ Transit as the woman who was struck, NJ Transit spokeswoman Lisa Torbic said. The details surrounding Juengling's death were not available. Man struck and killed by NJ Transit train in Montclair is identified A 53-year-old man was fatally struck by an early-morning NJ Transit train on the Montclair-Boonton Line on Monday. Stephen Korbel of Montclair was hit by the train at 5:20 a.m. just west of Watchung Avenue in Montclair, NJ Transit officials said. The train was carrying 30 passengers and crew members, said Lisa Torbic, a spokeswoman for NJ Transit. The train had been headed toward New York Penn Station, but the passengers were moved to an NJ Transit bus. It was not known why Korbel was on the tracks. NJ Transit police are investigating. This is the same spot another  Montclair resident, Joan Juenling , was killed by a train in November. Delays on the Montclair-Booton Line reached 60 minutes before returning to normal around 11:15 a.m.  A number of trains on the line were delayed or canceled, and NJ Transit cross-honored rail tickets on its buses.

The verdict was given by Judge Heidi Cesare from the bench  after a trial that lasted more than two days . The Manhattan DA's office offered Lewis a plea deal that would have handed him a $1,000 fine, driver remediation classes, and a six-month license suspension, but he chose not to take it. Lewis will be sentenced on October 22nd, and he now faces up to 30 days in jail.
